Welcome to Mashawir. These Terms & Conditions ("Terms") govern your use of the Mashawir app, website and services (the "Platform") operated by Mashawir Technology Solutions Co. Ltd. (the "Company", "we"). By using the Platform you agree to these Terms; if you do not agree, please do not use the Platform.
1. Nature of the service
- Mashawir is a technology platform that connects riders with independent drivers ("Partners") to make ordering city trips easier.
- The Company does not provide transportation itself. Trips are provided by Partner drivers as independent contractors; the Company acts as a technology intermediary organising requests, execution and payment.
- New services (such as delivery) may be added and are subject to these Terms unless stated otherwise.
2. Eligibility and account
- You must be at least 18 years old to create an account and use the service.
- You are responsible for the accuracy of your details, for keeping your login credentials confidential, and for all activity on your account.
- The Company may suspend or close any account that breaches these Terms or is used fraudulently or abusively.
3. Ordering trips
- When you enter a destination and choose a car type, the app shows an estimated fare and arrival time. The final fare may differ if the route changes, stops are added or road conditions vary.
- The request is sent to the nearest available drivers and is confirmed once a driver accepts it.
- The Cancellation & Refund Policy applies to any cancellation after a request is accepted.
4. Fares and payment
- Fares are calculated according to the tariff shown in the app (base fare + distance + time) and may include waiting or cancellation fees.
- You may pay the driver in cash or through the digital payment methods available in the app.
- The Company may change the tariff at any time; the estimated fare is always shown before you confirm.
5. User conduct
You agree to:
- Treat drivers and others with respect and not damage the vehicle.
- Not use the Platform for any unlawful purpose or to transport prohibited items.
- Not manipulate the app or attempt unauthorised access to its systems.
- Follow the safety rules and community guidelines published on the Platform.
6. Safety
We verify drivers' identities and vehicles and provide in-app safety tools (trip sharing, emergency button, two-way ratings). Nevertheless, a trip is an agreement between the rider and the driver, and, to the extent permitted by law, the Company is not liable for damages not caused by its direct negligence.
7. Intellectual property
All rights in the Platform, including the logo, design, software and content, belong to the Company or its licensors. They may not be copied or reused without written permission.
8. Limitation of liability
To the extent permitted by law, the Company is not liable for indirect or consequential losses arising from the use or unavailability of the Platform. In any case, the Company's total liability shall not exceed the value of the trip in dispute.
9. Changes to these Terms
We may update these Terms from time to time and will notify you of material changes through the app or website. Continued use of the Platform after an update means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of the Republic of Sudan, and its courts have jurisdiction over any dispute, after an attempt at amicable settlement through our support team.
