These terms govern the relationship between the independent driver (the "Partner") and Mashawir Technology Solutions Co. Ltd. (the "Company") when using the driver app to receive trip requests through the Mashawir platform. By activating your driver account you agree to these terms in addition to the general Terms & Conditions and the Privacy Policy.
1. Nature of the relationship
- The Partner is an independent contractor, not an employee of the Company, and retains full freedom to choose working hours and which requests to accept.
- These terms do not create any employment, legal partnership or agency relationship.
2. Onboarding requirements
- Aged 21 or above.
- A valid driving licence and a valid national ID.
- A vehicle in good condition that meets safety requirements, with its legal documents (registration and insurance where applicable).
- Passing the data and document verification process and any additional check the Company requires.
- Keeping documents up to date when they expire.
3. Performing trips
- Requests are sent to the drivers nearest to the rider, and the Partner may accept or decline any request.
- After accepting, the Partner must head to the rider promptly and complete the trip via the most suitable route.
- Repeated cancellations after acceptance or unjustified delays may affect the Partner's priority for requests or lead to account suspension.
- Requesting any amount beyond the fare shown in the app is prohibited.
4. Fares, commission and payouts
- Fares are calculated automatically according to the tariff shown in the app.
- The Company deducts the platform commission shown in the app from each trip; changes to the commission rate are announced in advance.
- The Partner's balance is paid out according to the published payout schedule. The Partner is responsible for any taxes and fees legally due.
- For cash trips, the Partner collects the fare directly from the rider and the commission is settled through the app mechanism.
5. Conduct and safety
- Treat riders with respect and comply with traffic and safety rules.
- Never drive under the influence of any substance that impairs driving.
- Keep the vehicle clean and roadworthy.
- Do not share the account with anyone else and drive only the registered vehicle.
- Report any accident or complaint immediately through the app.
6. Data and privacy
The Partner agrees to the collection of location data while online and to sharing basic details (name, profile photo, vehicle details and plate number, rating) with riders, in line with the Privacy Policy.
7. Suspension and termination
The Company may suspend or terminate a Partner's account for breaches of these terms, repeatedly low ratings, serious complaints or expired documents. The Partner may stop using the platform at any time.
8. Liability
The Partner is responsible for their driving, their vehicle and any damage caused by their negligence. To the extent permitted by law, the Company is not liable for obligations arising between the Partner and riders or third parties.
9. Changes and governing law
The Company may amend these terms with notice through the app. These terms are governed by the laws of the Republic of Sudan.
